Hydi Terms of Service

These Terms of Service (hereinafter referred to as "Terms") set forth the conditions for use of the macOS screen recording application "Hydi" (hereinafter referred to as "the App") provided by Yoshihiro Nakaoka (hereinafter referred to as "we" or "us"). Please read these Terms carefully before using the App. By downloading, installing, or using the App, you are deemed to have agreed to these Terms.

Note: These Terms govern the service usage conditions of the App. The software license for the App is governed by the Apple Standard EULA for the App Store (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). In the event of any conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA shall apply to software licensing matters, while these Terms shall apply to service usage conditions (subscriptions, governing law, prohibited activities, etc.).


Article 1 (Scope of Application)

These Terms apply to all relationships between you and us regarding the use of the App.


Article 2 (Overview of the App)

The App is an application for recording your screen on macOS and creating videos with keystroke and mouse click visualizations.


Article 3 (System Requirements and Permissions)

3.1 Required Permissions

To use the features of the App, you must grant the following permissions in macOS System Settings:

- Screen Recording: Required for recording your screen
- Accessibility (Input Monitoring): Required for displaying keystrokes and mouse clicks

If you do not grant these permissions, some or all features of the App will be unavailable.

3.2 Managing Permissions

The above permissions can be changed at any time from macOS "System Settings" > "Privacy & Security." If you revoke a permission, the corresponding feature will become unavailable.


Article 4 (Subscriptions)

4.1 Plans and Pricing

The App offers the following plans:

Free Plan:
The following basic features are available for free.
- Screen recording
- Keystroke and mouse click display
- Basic annotation features
- Trimming and speed adjustment
* A watermark is displayed on output videos in the Free plan.

Standard Plan (¥1,280/month, tax included / 1-month auto-renewable subscription):
In addition to all Free plan features, the following are available.
- Watermark removal
- New features added in the future

Pro Plan (¥1,480/month, tax included / 1-month auto-renewable subscription):
Currently in preparation. Pro-exclusive features will be added in the future.

Prices include applicable taxes and may vary depending on your region and App Store exchange rates. Please check the App Store for the latest accurate pricing.

4.2 Free Trial

Each subscription plan offers a 14-day free trial period. During the trial period, you can use all features of the selected plan.

Important: If you do not cancel at least 24 hours before the end of the trial period, you will automatically be converted to a paid subscription and charges will apply.

4.3 Subscription Period and Auto-Renewal

Each paid subscription (Standard, Pro) has a period of 1 month. Subscriptions automatically renew for 1 month at the same price unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged upon purchase confirmation. Renewal charges will be processed within 24 hours before the end of the current period.

4.4 How to Cancel

You can cancel your subscription at any time by following these steps:

1. Open "System Settings" on your Mac
2. Click on your Apple ID
3. Select "Media & Purchases"
4. Click "Manage" under "Subscriptions"
5. Select "Hydi" and cancel the subscription

After cancellation, you can continue to use subscription features until the end of the current billing period.

4.5 Refunds

Subscription refunds are subject to Apple's refund policy. If you wish to request a refund, please do so through Apple's refund request page (https://reportaproblem.apple.com/).

4.6 Restore Purchases

To restore a previously purchased subscription, use the "Restore Purchases" option in the App's settings.


Article 5 (Prohibited Activities)

You shall not engage in any of the following activities when using the App:

1. Activities that violate laws, regulations, or public order and morals
2. Activities that infringe on the intellectual property rights, privacy, or other rights of third parties
3. Reverse engineering, decompiling, or disassembling the App
4. Copying, modifying, or distributing the App
5. Using the App for fraudulent or unlawful purposes
6. Activities that cause damage to us or third parties
7. Recording screens that include third parties without their consent
8. Recording meetings, calls, or other communications without the consent of participants
9. Recording and distributing copyrighted content without permission from the rights holder
10. Recording for the purpose of unlawfully obtaining confidential or personal information
11. Any other activities that we deem inappropriate


Article 6 (Responsibility for Recorded Content)

1. You bear full responsibility for any recorded content created using the App.
2. If third parties appear in the recording, please obtain their consent in advance.
3. When recording online meetings, calls, video calls, etc., please notify all participants in advance and obtain their consent.
4. When publishing recorded content (including uploading to YouTube, social media, or other platforms), please comply with applicable laws, platform terms, and the rights of third parties.
5. When using the App in a workplace environment, please comply with your employment contract, work regulations, and company policies.


Article 7 (Intellectual Property Rights)

Intellectual property rights related to the App and its related content (logos, designs, source code, etc.) belong to us or the rightful owners. These Terms do not transfer any intellectual property rights to you.


Article 8 (Disclaimer)

1. We make no warranties, express or implied, regarding the content, quality, functionality, accuracy, or usefulness of the App.
2. We shall not be liable for any damages, including data loss, system failures, or any other damages arising from the use of the App, except in cases of intentional misconduct or gross negligence on our part.
3. We have no obligation to notify you in advance of any interruption, suspension, termination, unavailability, or changes to the App, and shall not be liable for any damages arising therefrom, except in cases of intentional misconduct or gross negligence on our part.
4. We are not responsible for any content recorded by you through the App. Please verify the legality of recorded content at your own responsibility.


Article 9 (Termination of Service)

1. We may terminate the provision of the App at our discretion.
2. If we decide to terminate the App, we will notify you at least 30 days before the termination date through the App or our website, except in cases of urgent and unavoidable circumstances.


Article 10 (Changes to Terms)

1. We may change these Terms without prior notice to you when we deem it necessary.
2. The revised Terms shall take effect from the time they are posted in the App or on our website.
3. If you continue to use the App after the Terms have been revised, you shall be deemed to have agreed to the revised Terms.


Article 11 (Privacy)

11.1 Privacy Policy

The handling of personal information in the App shall be governed by a separately established Privacy Policy, and you agree to this Privacy Policy when using the App.

11.2 Data Handling

The App handles data according to the following policies:

- Recording Data: Stored locally on your device. It is never sent to our servers.
- Analytics Data: The App does not use third-party analytics SDKs (such as Firebase Analytics or Crashlytics).
- Billing Information: Managed by Apple through the App Store. We do not directly obtain your payment information.
- Support Inquiries: If you contact us for support, we will use your email address and inquiry content only for the purpose of responding to your inquiry.


Article 12 (General Provisions)

12.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.2 Prohibition of Assignment

You may not assign or pledge the rights or obligations under these Terms to a third party without our prior written consent.

12.3 Notices

Notices from us to you shall be made through displays within the App, postings on our website, or other methods we deem appropriate.


Article 13 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. In the event of any dispute arising in connection with the App, the Matsuyama District Court shall have exclusive jurisdiction as the court of first instance.
